These Terms & Conditions (together with any documents referred to in them) govern the supply of products (“Products”) by Musto Australasia Pty Ltd to you through our website www.musto.com.au (“Site”).

By accessing or using the Site, including placing an order, you agree to be bound by these Terms & Conditions. If you do not agree, you must not use the Site.

We recommend that you read these Terms carefully and retain a copy for future reference.

3. Eligibility & Use of the Site

By placing an order, you confirm that:

  • You are legally capable of entering into binding contracts

  • Products are purchased for personal use only and not for resale

This Site is intended for customers located in Australia and New Zealand only.

 

4. Product Information & Pricing

  • All prices are shown in AUD or NZD (as applicable) and include GST where required.

  • Prices exclude delivery charges unless stated otherwise.

  • We reserve the right to correct pricing or product errors at any time.

  • If an obvious pricing error occurs, we may cancel the order and issue a full refund.

Product images and descriptions are for illustrative purposes only. Colours and measurements may vary slightly.

 

5. Orders & Contract Formation

  • Submitting an order constitutes an offer to purchase.

  • Orders are subject to acceptance and availability.

  • A contract is formed only when we dispatch your order and send a dispatch confirmation email.

  • If part of your order is unavailable, only dispatched items form part of the contract.

 

6. Payment

We accept payment methods made available at checkout, which may include credit/debit cards, Shop Pay, Afterpay, and PayPal.

Payment is taken at the time your order is dispatched. All payments are subject to the terms and conditions of the relevant payment provider.

If we are unable to fulfil your order, any payment taken will be refunded in full.

 

7. Delivery

  • Delivery costs and estimated timeframes are shown at checkout and on our Delivery & Returns page.

  • Delivery times are estimates only and may vary due to factors beyond our control.

  • Risk passes to you upon delivery.

  • Title to Products passes once payment has been received in full.

 

8. Returns & Refunds

Change of Mind Returns

You may return one or more Products for a refund or exchange within 30 days of receiving your order, provided that:

  • Items are in fully resalable condition

  • Items are unused, unworn, unwashed, and free from damage

  • All original packaging, tags, and accessories are returned

  • Items packaged in a box (for example, footwear) are returned as originally supplied

Returns must be registered through our online returns portal and approved prior to sending items back to us. Return shipping costs are your responsibility unless the Product is faulty or incorrect.

Faulty or Incorrect Items

Nothing in these Terms limits your rights under Australian Consumer Law or the New Zealand Consumer Guarantees Act.

If a Product is faulty, unsafe, or not as described, you are entitled to a repair, replacement, or refund, including return shipping costs where applicable.

 

9. Warranty

Our Products come with guarantees that cannot be excluded under Australian Consumer Law and the New Zealand Consumer Guarantees Act.

In addition to these statutory guarantees, some Products may be covered by a manufacturer’s warranty. Warranty coverage does not apply to damage caused by normal wear and tear, misuse, accident, alteration, improper care, or failure to follow care instructions.

If you believe a Product has a manufacturing defect, please contact us or lodge a request through our Warranty & Repairs process. We will assess the Product and, where appropriate, offer a repair, replacement, or refund in accordance with applicable consumer law.

 

10. Intellectual Property

All content on the Site (including text, images, logos, graphics, and designs) is owned by or licensed to Musto Australasia and is protected by copyright and trademark laws.

You may not copy, reproduce, distribute, modify, or commercially exploit any content without our prior written consent.

 

11. Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, or consequential losses.

  • Our total liability is limited to the value of the Products purchased.

Nothing in these Terms excludes or limits liability that cannot be excluded under law, including consumer guarantees.

 

12. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, transport disruptions, or system failures.

 

13. Third-Party Links

The Site may contain links to external websites. We are not responsible for their content, availability, or practices.

 

14. Governing Law

These Terms are governed by the laws of Australia, and disputes may be heard in Australian courts.

 

15. General

  • These Terms constitute the entire agreement between you and us.

  • If any part is found unenforceable, the remaining provisions remain valid.

  • Failure to enforce a right does not constitute a waiver.
